New lifejacket rules: What Kiwi boaties need to know

From 9 October 2026, adults and children aboard recreational craft 6 metres or less in length must wear a lifejacket while underway. The rule covers motorboats, dinghies, jetskis, kayaks, small sailing craft and paddleboards.

A craft is underway unless it is anchored, attached to a dock or shore or aground.  “Underway” includes drifting, even with the engine switched off, so, if you’re drift fishing, your lifejacket needs to stay on.

The six-metre threshold is measured using the craft’s permanent structure, excluding accessories such as outboard motors and boarding platforms. Existing requirements continue for larger recreational boats, including carrying a suitable lifejacket for everyone and wearing them during heightened risk.

The skipper is responsible for ensuring everyone on board complies with the lifejacket requirements.

As at 30 September 2026, specific offences and penalties for the new requirement have not yet been established. However, existing laws still allow prosecution where breaches cause significant harm or involve dangerous activity.

Before your next trip, check that everyone has a correctly fitted lifejacket in good condition. Make putting it on part of your routine before heading out.
